The workshop focuses primarily on preparation for, and dealing with, a labour inspection regarding the basic terms and conditions of employment, including how to identify labour inspectors, typical documents requested during inspections and the consequences of non-compliance.

This practical workshop will be delivered online in 1 easy-to-understand part and is designed to help you better understand the core principles, as well as compliance with labour legislation.

What you will learn in this workshop:
The Department of Employment and Labour plays a key role in ensuring that employers and employees comply with South African labour legislation. To this end, the department uses labour inspectors to conduct labour inspections.

Labour inspections are a common occurrence in the workplace with the potential to have a major impact on business activities, especially when businesses do not comply with legislation. Non-compliance can result in compliance orders, fines and even imprisonment.

It is essential that employers know what to expect during a labour inspection in order to continuously comply with labour legislation.

The following key aspects of labour inspections are covered during the workshop:

  • The role of labour inspections and inspectors, the importance of an inspector’s certificate of appointment and examples of identification prescribed by legislation and used by inspectors in practice.
  • Preparation for a labour inspection, including a sample inspection notice and typical questions inspectors ask employees.
  • A general checklist of documents and items that inspectors often request.
  • Consequences of not complying with the NMLW requirements and compliance orders under both the BCEA and the NMLW.

Additional benefit: participants attending the workshop will also receive information specifically on compliance orders (notices) for non-compliance with the Occupational Health and Safety legislation.
